S. 1049 Covering Kids Act of 2005 (PDF)

This bill would give states the option to find children income-eligible for Medicaid or SCHIP based on the fact that they are already enrolled in another public means-tested program. It also provides grants to states and communities for outreach and enrollment activities. This bill was introduced in 2005 but not enacted.

This bill would give states the option to find children income-eligible for Medicaid or SCHIP based on the fact that they are already enrolled in another public means-tested program. The intent of the bill is to allow states the flexibility of implementing an automatic Express Lane Eligibility program that would make it easier for uninsured but eligible children to enroll in Medicaid and SCHIP. This bill was introduced in 2005 but not enacted.

Included in this comprehensive child health coverage legislation is a provision that would allow states the option to find children income-eligible for Medicaid or SCHIP based on the fact that they are already enrolled in another public means-tested program. The Express Lane provision is part of a multi-faceted effort to streamline the enrollment process, including other measures such as requiring states to adopt 12-month continuous enrollment, accept self-declaration of income, and remove the assets test. This bill was introduced in 2005 but not enacted.

Subtitle D, Section 131 of this Act would allow states to deem children to have met Medicaid’s financial eligibility requirements based on a determination of income and resources by another Federal or State agency within the prior twelve months, as long as the agency bears a real or potential fiscal impact from that determination. This proposal is part of comprehensive legislation to improve and fund health coverage for low-income families, especially those in the Hispanic community. This bill was introduced in 2002 but was not enacted.

Section 1121(a)(E) of this Act would require states to coordinate enrollment of children under Medicaid and SCHIP with enrollment in other Federal means-tested public assistance programs. This proposal is part of comprehensive legislation to improve all children’s services that was introduced in 2001 but was not enacted.

P.L. 106-224 Agricultural Risk Protection Act of 2000

Subtitle E, Section 242 of this Act amended the National School Lunch Act to facilitate disclosure of contact and eligibility information from school lunch applications to Medicaid and SCHIP agencies. This law allows schools and school districts to share school lunch information with the state health insurance agencies for outreach and enrollment activities without obtaining parental consent. The law, enacted in 2000, stipulates that parents or guardians must be notified and given the opportunity to elect not to have their children's eligibility information disclosed to Medicaid or SCHIP.
